1. Business Information (ECT Act, Section 43)

In compliance with Section 43 of the ECT Act, we provide the following mandatory disclosures:

By using this website and placing orders, you confirm that you are at least 18 years of age, or have obtained the consent of a parent or legal guardian. You confirm that you are legally capable of entering into a binding agreement under South African law.

3. Products and Descriptions

We make every effort to display and describe our products as accurately as possible, including product images, descriptions, sizes, and pricing. However, we do not warrant that product images, colours, or descriptions are entirely accurate due to variations in screen displays and photography.

All products listed on our website are subject to availability. We reserve the right to discontinue any product at any time. If a product you have ordered is unavailable, we will notify you promptly and offer a full refund or an alternative product of equal value.

4. Pricing and Payment

All prices displayed on our website are in South African Rand (ZAR) and are inclusive of VAT at the applicable rate (currently 15%), unless otherwise stated.

We reserve the right to change prices at any time without prior notice. However, once an order has been confirmed and payment received, the price will not change for that transaction.

We accept the following payment methods via PayFast: American Express, Visa Credit Card, Visa Debit Card, Instant EFT, SCode, QR Code Apps, Zapper, SnapScan, Samsung Pay, Mukuru Cash, Mobicred, and Apple Pay.

5. Order Confirmation and Acceptance

When you place an order through our website, you are making an offer to purchase the selected products. An order confirmation email is sent as an acknowledgement of your order and does not constitute acceptance of the offer.

A binding agreement is formed only when your order has been dispatched, at which point you will receive a dispatch confirmation. We reserve the right to decline or cancel any order for reasons including (but not limited to) product unavailability, pricing errors, or suspected fraud.

In terms of Section 46 of the ECT Act, we will fulfil accepted orders within 30 days of receiving the order, unless otherwise agreed. If we are unable to fulfil your order within this period, you will be notified and may cancel for a full refund.

6. Delivery

We deliver to addresses within South Africa only, using The Courier Guy and PUDO. Estimated delivery time is 2–3 working days from dispatch. Please refer to our Shipping Policy for full details on delivery timeframes, costs, and conditions.

Risk in the goods passes to you upon delivery. Title (ownership) of the goods passes to you once full payment has been received and the goods have been delivered.

7. Cooling-Off Period and Returns

In terms of Section 44 of the ECT Act, you have the right to cancel your purchase and return goods within 7 days of delivery, without providing a reason, subject to the conditions outlined in our Refund & Returns Policy. The direct cost of returning the goods is payable by you.

Additionally, under Section 56 of the CPA, all goods carry an implied warranty of quality for 6 months from delivery. Defective goods may be returned for a refund, replacement, or repair at the consumer's election.

8. Consumer Rights

As a consumer, you are entitled to the following rights under South African law:

• Right to Fair and Honest Dealing (CPA, s40–47): We will not use unfair, unreasonable, or unjust contract terms or engage in deceptive marketing practices
• Right to Fair Value, Good Quality, and Safety (CPA, s53–61): All products sold must be safe, of good quality, and fit for their intended purpose
• Right to Disclosure and Information (CPA, s22–28): You are entitled to clear, accurate information about our products, prices, and terms in plain language
• Right to Privacy (POPIA): Your personal information is collected, processed, and stored in compliance with POPIA. Please refer to our Privacy Policy for full details
• Right to Choose (CPA, s13–14): You have the right to select your goods and suppliers freely, without being subjected to bundling or forced transactions

9. Intellectual Property

All content on this website — including but not limited to text, images, logos, graphics, product photographs, and design elements — is the property of Unlimited Fragrances (Pty) Ltd or its licensors and is protected by South African intellectual property law, including the Copyright Act 98 of 1978 and the Trade Marks Act 194 of 1993.

You may not reproduce, distribute, modify, or use any content from this website without our prior written consent.

10. User Conduct

You agree not to use our website for any unlawful purpose or in any way that could damage, disable, or impair the website. Specifically, you agree not to:

• Use automated systems (bots, scrapers) to access the website without permission
• Attempt to gain unauthorised access to any part of the website, server, or database
• Submit false or misleading information during registration or checkout
• Engage in any activity that constitutes fraud or misuse of the platform

11. Limitation of Liability

To the maximum extent permitted by law, Unlimited Fragrances (Pty) Ltd shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the website or the purchase of our products. This includes (but is not limited to) loss of profits, data, or business opportunities.

Nothing in these terms excludes or limits liability that cannot be excluded or limited under South African law, including liability for defective goods under Section 61 of the CPA.

12. Indemnification

You agree to indemnify and hold harmless Unlimited Fragrances (Pty) Ltd, its directors, employees, and agents from any claims, liabilities, damages, costs, or expenses (including legal fees) arising from your breach of these Terms of Service, your misuse of the website, or any violation of applicable law.

13. Force Majeure

Unlimited Fragrances shall not be held liable for any delay or failure in performance arising from circumstances beyond our reasonable control, including but not limited to natural disasters, pandemics, government actions, power failures, internet outages, courier disruptions, or acts of terrorism.

14. Dispute Resolution

In the event of a dispute arising from these terms or any transaction with Unlimited Fragrances, the parties agree to first attempt to resolve the matter through direct negotiation. If the dispute cannot be resolved informally, either party may refer the matter to:

These terms are governed by the laws of the Republic of South Africa, and the parties submit to the jurisdiction of the South African courts.

15. Plain Language

In compliance with Section 22 of the CPA, these Terms of Service are written in plain language so that an ordinary consumer with average literacy and minimal experience in purchasing fragrances online can understand them. If any provision of these terms is unclear, please contact us for clarification.

16. Amendments

We reserve the right to update or amend these Terms of Service at any time. Changes will take effect upon publication on our website. Your continued use of the website following any changes constitutes acceptance of the revised terms. We encourage you to review these terms periodically.

17. Severability

If any provision of these Terms of Service is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.
